D’s hearing for his reckless endangerment charge was this morning. The hearing went OK, though the judge yelled at him. But since he had no prior record – not even so much as a ticket – the DA made a deal with him to get two years probation. If he gets pulled over again by a state trooper or in Jefferson County during that time, he’ll be sent to jail for 12 months. Do not pass go. Do not collect $200.
The fine and court costs were $705, and we have to pay the lawyer $600 (which we are happy to pay because he was worth it). But it could’ve been worse. The maximum fine for a Class A misdemeanor in Alabama is $2,000 (not including court costs), and he could’ve gone to prison for a year. Also, since it is a crime and not a traffic violation, it can’t affect his driver’s license or insurance. Thank goodness for small favors.
And when the Judge’s term is up for election, Darwin can still vote!
I’m glad it turned out ok. I enjoy your blog and you seem like good people. However, I hope Darwin will think really carefully about speeding. Driving at 100 MPH virtally ensures that anyone involved in an accident will be killed or very seriously injured. Airbags or no, you will not survive and neither will the person you hit. If you are stupid enough drive in a fashion that will kill you, that is your problem (or as another Darwin would say, natural selection), but you when you drive out there at that speed you also risk my life and my family’s life. Speeding and reckless driving are not victimless crimes.
This whole thing is very scary. Thank God he didn’t have to go to jail. I am sure he won’t be speeding like that anytime soon. It seems very severe for a first offense, but I agree that speeding that fast is pretty dangerous. Glad you guys are going to be ok.

Who knew you could actually be thankful for being convicted of a crime instead of a traffic violation. Happy to hear that everything went as well as you could hope.

Don’t worry, Chris, the lead is permanently removed from his shoe. ;) Now he is driving like my 84-year-old grandpa. He has most definitely learned his lesson.
